Terms and Conditions

Payment and fees: The Client agrees to pay the Photographer the agreed-upon fee for the photography services provided. Payment is due in full on or before the date of the shoot. In the event that payment is not made on time, the Photographer reserves the right to withhold services until payment is received.
Cancellation and rescheduling: If the Client cancels or reschedules the shoot less than 24 hours before the scheduled time, the Photographer may charge a cancellation fee. If the Photographer cancels or reschedules the shoot due to unforeseen circumstances, a new date will be scheduled at no additional cost to the Client.
Ownership and use of images: The Photographer retains all rights to the images produced during the shoot, including the right to use the images for promotional purposes. The Client may use the images for personal use only and may not sell or license the images to any third party without the Photographer's prior written consent. The Client acknowledges that the Photographer is not responsible for providing makeup, wardrobe, props, or other materials or services not explicitly agreed to in writing prior to the shoot. Any additional services or materials provided by the Photographer will be subject to additional fees as agreed to by the Client.
Liability and indemnification: The Client agrees to indemnify and hold harmless the Photographer from any and all claims, damages, or expenses arising out of the Client's use of the images or the Client's breach of these terms and conditions.
Limitation of liability: The Photographer's liability for any claims arising out of or related to the photography services provided shall be limited to the amount paid by the Client for such services.
Governing law and dispute resolution: These terms and conditions shall be governed by the laws of the Philippines. Any disputes arising out of or related to these terms and conditions shall be resolved through binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI).
Image delivery and storage: The Photographer will deliver the edited digital images to the Client within 5-30 days after the shoot, in either JPEG, PNG, or JPG format as mutually agreed upon. The Photographer will store the images for a maximum of 60 days after the shoot, after which the Photographer may delete or destroy the images. The Client is responsible for ensuring that they have saved a backup of the images. The printed copies of the images, if agreed to in writing prior to the shoot, will be delivered to the Client within 45 days after the shoot, subject to any delays outside the Photographer's control.
Confidentiality: The Photographer agrees to keep confidential any personal or proprietary information provided by the Client in connection with the photography services, including but not limited to the Client's contact information, business practices, or trade secrets.
Copyright notice: The Client agrees to include a copyright notice on any public display or distribution of the images, including but not limited to social media, websites, or promotional materials. The copyright notice shall read "© 2023 JITHYR A. CANJA. All rights reserved."
Model releases: The Client acknowledges that it is their responsibility to obtain any necessary model releases or other permissions for the use of the images, and agrees to indemnify and hold harmless the Photographer for any claims arising out of the Client's failure to do so.
Force majeure: The Photographer shall not be liable for any delays or failures to perform under these terms and conditions resulting from causes beyond their reasonable control, including but not limited to acts of God, war, terrorism, or governmental action.
Entire agreement: These terms and conditions constitute the entire agreement between the parties and supersede all prior negotiations, agreements, or understandings, whether written or oral, relating to the subject matter herein.
Modifications: These terms and conditions may not be modified or amended except in writing signed by both parties.
